1. Introduction and Acceptance of Terms

Welcome to OntarioEstateLawyers.com (the “Site”), which is owned and operated by Hogarth Hermiston Severs LLP (the “Firm”). These Terms and Conditions govern your use of the Site and the services and information provided herein. By accessing or using this Site, you agree to be bound by these Terms and Conditions. If you do not agree with any of these terms, please do not use the Site.

The Site describes the Firm’s legal services in the Province of Ontario, Canada. Ashley Harmon is the only lawyer whose services are advertised on this Site. The Firm is a legal-services provider (not a third-party advertising platform) and offers its services exclusively to the public in Ontario.

2. Not Legal Advice – Informational Purposes Only

All content on this Site is provided for general information and advertising purposes only. Nothing on this Site constitutes legal advice, and the content may not reflect current legal developments. Do not act or refrain from acting on the basis of any information on this Site without first obtaining appropriate legal or professional advice.

3. No Lawyer–Client Relationship

Use of this Site or communication with the Firm or Ashley Harmon through the Site (including email or contact forms) does not create a lawyer–client relationship. A solicitor-client relationship arises only after (i) a direct consultation, (ii) a conflicts check, and (iii) a signed written retainer or engagement agreement.

Unless and until you become an official client of the Firm, information you provide through this Site is not protected by solicitor-client privilege and should not be treated as confidential.

4. Jurisdiction and Licensure (Ontario Only)

The Firm’s services are offered solely for matters under Ontario law. Ashley Harmon is licensed to practise law only in Ontario. The Site is not an offer to provide legal services in any other jurisdiction, and the Firm does not seek to represent anyone in a jurisdiction where it is not licensed or where the Site would violate local laws.

5. Use of the Site and User Responsibilities

You agree to use the Site only for lawful purposes and in accordance with these Terms. You will not:

  • Introduce viruses, malware, or other harmful material.

  • Attempt to gain unauthorised access to the Site, its servers, or related databases.

  • Frame the Site, misrepresent a link as an endorsement, or associate the Site with false or misleading material.

The Firm may suspend or terminate your access at any time for any breach of these Terms.

6. Intellectual Property Rights

All content on the Site—including text, graphics, logos, images, audio/video clips, and software—is the property of Hogarth Hermiston Severs LLP or its content suppliers and is protected by Canadian and international intellectual-property laws. You may print or download material for personal, non-commercial use only. Any other use requires the Firm’s prior written consent.

7. Third-Party Links

The Site may contain links to third-party websites for convenience. Such links do not imply endorsement. The Firm is not responsible for the content, security, or availability of external sites and will not be liable for any loss or damage arising from their use.

8. Disclaimer of Warranties

The Site and all content are provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to warranties of accuracy, completeness, merchantability, fitness for a particular purpose, or non-infringement. The Firm does not warrant that the Site will be uninterrupted or error-free or that it is free of viruses or other harmful components.

9. Limitation of Liability

To the maximum extent permitted by law, the Firm, its partners, employees, agents, and affiliates will not be liable for any direct, indirect, incidental, special, consequential, punitive, or other damages arising out of or in connection with your use of, or inability to use, the Site or its content—even if advised of the possibility of such damages.

10. Privacy

Use of the Site may involve the collection and use of personal information. The Firm’s practices are set out in its separate Privacy Policy, which forms part of these Terms. By using the Site and providing personal information, you consent to such collection, use, and disclosure in accordance with that policy.

11. Changes to These Terms

The Firm may amend these Terms at any time without notice. Changes are effective immediately upon posting. Your continued use of the Site after any amendment signifies acceptance of the revised Terms. If you disagree with any change, you must stop using the Site.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. You agree to the exclusive jurisdiction of the courts of Ontario for any dispute relating to these Terms or your use of the Site.

13. Entire Agreement and Severability

These Terms (together with any additional policies posted on the Site, including the Privacy Policy) constitute the entire agreement between you and the Firm regarding your use of the Site. If any provision is held invalid or unenforceable, that provision will be severed and the remaining provisions will remain in full force and effect.
